Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of PodPitchr (the "Service"), operated by S&H Creatives LTD, a company registered in England and Wales ("PodPitchr", "we", "us"). By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.

2. The Service

PodPitchr is a software-as-a-service tool that helps creators and founders draft and send pitches to podcasts, awards programmes, and speaking events. The Service includes opportunity discovery, AI pitch drafting in your voice, automated follow-up sequences, reply tracking, and pipeline management.

We may add, remove or modify features over time. We will give reasonable notice of any change that materially reduces functionality on a paid tier.

3. Account

You must provide accurate information at signup and keep your password confidential. You are responsible for everything that happens under your account. Notify us immediately at legal@podpitchr.com if you suspect unauthorised access.

You must be at least 18 years old and capable of entering into a binding contract.

4. Subscription & billing

PodPitchr is offered on subscription tiers (Starter, Pro, Plus, Enterprise) plus a 7-day free trial. Pricing is shown on the pricing page. Payments are processed by a PCI-compliant payment provider; their own terms apply to the payment transaction.

  • Subscriptions auto-renew at the end of each billing period (monthly or yearly) until you cancel.
  • You can cancel at any time from the Subscription page; you keep access until the end of the current billing period.
  • We do not offer pro-rata refunds for partial periods, except where required by consumer law (e.g. statutory cooling-off rights in the EU/UK during the first 14 days, only where you have not yet sent a pitch).
  • If a payment fails, we will retry on a standard cadence; if we cannot collect, your account will be downgraded to the free tier or suspended.
  • We may change prices on 30 days' notice for the next billing period.

5. Usage limits

Each tier has monthly limits (pitches sent, searches, find-host-email runs, automated follow-ups per pitch). Limits are listed on the pricing page and enforced server-side. Limits reset at the start of each calendar month for paid tiers and at trial start for trial users.

6. Acceptable use

You agree NOT to use the Service to:

  • Send spam, unsolicited bulk email, or anything that violates CAN-SPAM, the UK PEC Regulations, or any equivalent law in the recipient's jurisdiction.
  • Send pitches that are deceptive, fraudulent, defamatory, or impersonate another person or organisation.
  • Harass, threaten or harm any recipient.
  • Bypass our rate limits or scrape the Service.
  • Use the Service to train competing AI systems on data you didn't generate yourself.
  • Resell or sublicense access to the Service.
  • Send pitches relating to illegal goods/services, regulated industries without proper authorisation (e.g. gambling, adult content, pharmaceuticals), or any sanctioned jurisdiction.

You are solely responsible for the content of pitches you draft and send. AI-generated drafts are a starting point; you must review every pitch before sending and ensure it is truthful and complies with all applicable laws.

7. Email sending compliance

When you connect your own mailbox or send through our shared sending domain, you are the legal sender of the email. You warrant that:

  • You have a legitimate business reason to contact each recipient.
  • You include accurate sender identification.
  • You honour unsubscribe and 'do not contact' requests promptly.
  • You comply with all applicable email marketing laws in your and the recipient's jurisdiction (UK PEC, EU ePrivacy + GDPR, US CAN-SPAM, CASL, etc.).

We may suspend or terminate accounts that produce a high bounce or spam complaint rate to protect deliverability for other users.

8. AI output

PodPitchr uses large language models to draft pitches in your voice. AI output is probabilistic and may occasionally be inaccurate, generic, or unsuitable. You must review every draft before sending. We make no warranty about the accuracy, originality, or booking effectiveness of AI-generated content.

9. Intellectual property

Your content. You retain ownership of all content you input (profile data, voice samples) and all pitches you draft and send. You grant us a limited licence to process that content solely to operate the Service.

Our platform. The Service software, design, opportunity scoring algorithms and brand are owned by PodPitchr and protected by intellectual property law. You may not copy, modify, or reverse-engineer the Service.

Feedback. If you send us suggestions or feedback, you grant us a perpetual, royalty-free licence to use them to improve the Service.

10. Service providers

The Service relies on a small number of infrastructure and tooling providers (for hosting, database, payments, AI inference, email delivery, and opportunity data). Your use of those providers, where you interact with them directly, is governed by their own terms. PodPitchr is not responsible for outages, errors, or data handling by those providers beyond our reasonable control. A current list of subprocessors is available on request from privacy@podpitchr.com.

11. Data & privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

12. Termination

You may cancel your subscription at any time from the Subscription page. We may suspend or terminate your account immediately, without refund, if you materially breach these Terms (in particular sections 6 and 7). On termination we will delete your account data per the retention schedule in the Privacy Policy.

13. Warranties & liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to these Terms or the Service is capped at the amount you paid us in the 12 months immediately preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, lost profits, or lost data.

Nothing in these Terms excludes liability that cannot be lawfully excluded, including (in the UK) liability for death or personal injury caused by negligence, or for fraud.

14. Indemnity

You agree to indemnify PodPitchr against any claim or loss arising from your content, your pitches, or your breach of these Terms — in particular any claim from an email recipient about spam, deception, or harassment.

15. Changes to these Terms

We may update these Terms. Material changes will be notified by email to registered users at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

16. Governing law & disputes

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts of England and Wales. Consumers in the EU/UK retain the right to bring claims in their country of residence under applicable consumer law.
